Despite the legalization of medical marijuana across all 33 states, rules regarding the production, sale, and travelling with CBD still remains unclear. Here is everything you need about CBD legalization and the new updated rule of TSA regarding flying with CBD.

Is CBD Legal In The United States?

Well, yes. In the year 2018, U.S. President Donald Trump signed the new Farm Bill Act of 2018, which took off CBD from the list of Schedule I controlled substances.
The farm bill legalized the production and sale of hemp and CBD extracted which contains less than 0.3% of THC.

The problem will arise only if the particular crop contains more than 0.3% THC.

The TSA Rule About Flying With CBD

The Transportation Security Administration recently updated its policy regarding medical marijuana on flights. It states,” Marijuana and certain cannabis-infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law except for products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by FDA.”

Epidiolex, the first CBD product approved by the FDA, is safe to take on flights. However, you can only get Epidiolex for your child with epilepsy and with prescription. Any other CBD products that you buy from nearest store or online are exempt from this rule.

However, TSA also makes it clear in their rule that their screening process is focussed on security and are designed to detect potential threats to aviation and passengers.  Thus, the TSA officers will not search for any CBD products or marijuana but if any illegal substance is found during the security screening, TSA will refer this matter to a law enforcement officer.

CBD oil is completely legal in all the 50 states, but if TSA notices something suspicious or illegal they are likely to create troubles for you. Therefore, being prepared will help you get through faster and will also minimise the chances of any questioning.

If you use CBD for medical reasons and have a prescription from a doctor, keep that with you to show it to the authorities if questioned.
Be sure that you possess CBD oil which is extracted from industrial hemp containing less than 0.3% of THC. If you have a Certificate Of Analysis that indicates the content of your oil, bring it along while traveling.

Keep CBD with you Toiletries

Make sure you put CBD oil in a clear liquids bag in your carry on instead of your checked luggage. Keeping CBD Oil in your carry on will minimize the chances of any trouble or your bag being seized as you will be present at the spot to show any required documentation or answer any question of the TSA.
As long as your CBD oil is in a plastic bag and below the weight limit of liquids in a carry on, it will not even be pulled out for any additional inspection. Note that you cannot take more than three ounces of CBD oil in your carry on bag.

Take your CBD supplement prior to your flight

If even after reading the above list, you are sceptical of taking CBD oil while flying, you should take your CBD supplement prior to your flight. If you are worried about jet lag or any other health-related issues that you might face while travelling, take your CBD oil in the morning so that you feel calm and stress-free while you are flying.
You can do some research on the CBD suppliers at your destination and purchase CBD oil after arriving or order it to your accommodations before leaving on your trip.
